2.1 חובות הגולש וכללי השימוש הוגן

• שימוש הוגן ובתום לב: חובה על הגולש להשתמש במערכות המידע של גולד לינק בתום לב ולמטרה כשרה בלבד, ולשמור על כללי זהירות כלליים ברשת האינטרנט על פי כל דין מקומי ובינלאומי.
• הגנה על זכויות יוצרים: כל התוכן באתר מוגן בזכויות יוצרים, לרבות קוד, תמונות וכיו"ב. אסור לבצע העתקה, שחזור, שינוי, שימוש מחדש, הורדה או הפצה של תוכן זה, מובהר כי המותג שותף בתוכנית הגנת מותג במנוע החיפוש העולמי של גוגל.
• הגבלת גישה: האתר שומר לעצמו את הזכות לחסום את הגישה עבור גולש מסוים או קהל מסוים ללא נימוק ו/או הודעה מוקדמת, כאשר האתר מוגדר כקניין עסקי פרטי המאפשר גישה ציבורית לשיקול דעתו הבלעדי.
• מנגנוני בקרה אוטומטיים וסינון פעילות עוינת: אתר האינטרנט מורכב ממערכת מידע שמסווגת את הגולשים לפי מספר רב של משתנים, והמערכת יכולה לחסום גולשים באופן אוטומטי על סמך הפרות אבטחה, שימוש במשאבים בצורה לא הוגנת, או חשש לריגול תעשייתי. קיימת בקרה אנושית בנוסף לפרוטוקול אבטחה מחמיר לזיהוי הפרות והפעלת אמצעים מיוחדים לנטרול מקור הפגיעה.
• חובת סינון רובוטים: כחלק מהמאמצים להגן על האתר ולסנן פעילות עוינת, אנו משתמשים בשירות reCAPTCHA של גוגל. שימוש בשירות reCAPTCHA הוא חובה כדי להבטיח שהפעילות באתר היא חוקית ובטוחה. המידע שנאסף באמצעותו כפוף למדיניות הפרטיות של גוגל.

3.1 הגבלת אחריות החברה

• אחריות מוגבלת לתשתית: כחברה המספקת שירותי ענן, אחריותנו הוגבלה לזמינות השירותים הבסיסיים ותוקפם ככל הניתן.
• הסרת אחריות על תוכן ופעילות: גולד לינק אינה נושאת אחריות לפעילות אתרים המאוחסנים בשרת שלה או לתוכן המתפרסם על התשתיות שלה. כל שימוש או פעילות שאינם חלק מהשירותים הבסיסיים הינו באחריותו הבלעדית של המשתמש הסופי.
• הסרת אחריות גלישה: גולד לינק מסירה מעצמה כל אחריות להשלכות שיכולות להיות מעצם הגלישה באתר או באתרים המאוחסנים בשרתיה. כל חבות ישירה או עקיפה ו/או אחריות על נזקים בעקבות גלישה, רכישה או מגע עם עובדי מפעיל שירות פומבי אינה באחריות החברה כלל ועיקר.
• היעדר זיקה משפטית: מובהר כי האתר אינו אחראי כלל ועיקר על תוצרי מפעיל שירות פומבי, והגולש מבין כי עצם אחסון הקבצים בשרתי גולד לינק לא מקנה לו זיקה משפטית לגולד לינק כאשר הוא גולש באתר של לקוח מפעיל.
• תנאי שימוש פרטניים: החברה שומרת לעצמה את הזכות להגדיר תנאים אחרים בפני כל לקוח בנפרד, לרבות תעריפים, תנאי שימוש או זמני אספקה, בהתאם לשיקול דעתה הבלעדי ומבלי שעליה לתת הסבר.

3.2 חובות מפעיל שירות פומבי

• אחריות בלעדית על תוכן ומוצרים: האחריות הבלעדית לשירותים ולמוצרים באתרי לקוחות היא של לקוחות גולד לינק בלבד. הלקוח מקבל על עצמו את כל הסיכון הכרוך בשימוש בשירותים הניתנים על ידי גולד לינק, לרבות סיכון של תביעות מצד צדדים שלישיים בגין פעולות המבוצעות באמצעות השירותים.
• שימוש חוקי ואבטחה: הלקוח מתחייב להשתמש בשירותי גולד לינק בהתאם לדין ובמטרות חוקיות בלבד. הלקוח מחויב להפעיל אמצעי אבטחת מידע נאותים על מנת למנוע ניצול לרעה של המשאבים, פרצות אבטחה או כל פעולה בלתי חוקית, לרבות עידוד אלימות או פעילות המפרה את זכויותיהם של צדדים שלישיים.
• ציות לדיני פרטיות ומיקום: הלקוח מחויב לפעול בהתאם לחוקי הגנת הפרטיות המקומיים והבינלאומיים, ולהבטיח שכל פעילות המתבצעת במסגרת השירותים עומדת בקנה אחד עם הרגולציה החלה בתחומי פעילותו. במידה ויתקבלו תלונות או תביעות בגין הפרות אלו, הלקוח יהיה האחראי הבלעדי לכל נזק או תוצאה הנובעת מכך.
• אחריות למשאבים וחריגה מרוחב פס: האחריות לניטור השימוש במשאבים מוטלת על הלקוח. במידה והלקוח לא בחר באפשרות לחסום את השירות באופן אוטומטי עם סיום מכסת רוחב הפס שהוקצתה לו, יחול חיוב נוסף בגין כל חריגה ממגבלת התעבורה. הלקוח מאשר ומבין כי גולד לינק אינה מחויבת להתריע על חריגה בזמן אמת.

3.3 הפסקת שירות וסנקציות חד-צדדיות

• סיום שירות בשיקול דעת בלעדי: גולד לינק שומרת לעצמה את הזכות לסיים את מתן השירותים ללקוח בכל עת, לפי שיקול דעתה הבלעדי וללא צורך במתן הודעה מוקדמת או נימוק.
• סנקציות מיידיות בהפרה: במקרה של פעילות עוינת או הפרה מהותית של תנאי השימוש, גולד לינק רשאית להשבית את השירותים באופן מיידי, למחוק את המידע המאוחסן בשרתים, ולדרוש פיצויים בגין נזקים ישירים ו/או עקיפים שנגרמו לה או לצדדים שלישיים.
• אי-זכאות להחזר: במקרה של סיום שירות עקב הפרה או אי-עמידה בתנאים, הלקוח לא יהיה זכאי להחזר כספי בגין יתרת התקופה שנותרה לשירותים שהופסקו.

פלטפורמת Vexa מציעה את "כוח AI-to-Production" ומאפשרת יצירת מדיה דיגיטלית מתקדמת. הפלטפורמה מאפשרת יצירה מיידית ללא הרשמה וללא פרטים ("Create instantly. No signup, no details").

• יצירה חופשית ושימוש פנימי: ניתן להשתמש בפלטפורמה ליצירה וליטוש של חומרים דיגיטליים. שימוש בתוצרים באופן פנימי (כגון צילום מסך) אינו נוגד את מדיניות החברה.
• אבטחת בעלות: על פי כללי Vexa, כל אחד יכול לתבוע חומרים בהיעדר בעלות מובטחת. הלקוח יכול לרכוש את אבטחת הבעלות בכל עת מאוחרת יותר, אך חומריו נשארים לא-נתבעים עד שמישהו אחר יבטיח בעלות.
• ציפייה לקרדיט: החברה מצפה כי קרדיט ל-Vexa יוזכר במקום כלשהו אם התוכן הדיגיטלי הוכן באמצעות הפלטפורמה.
• השקה: לאחר הבטחת הבעלות, הלקוח יכול לרכוש את החבילה הרצויה ישירות על החומרים ולהשיק את התוצר.

5.1 תשלום סופי ואי-החזר

• תשלום סופי: התשלום עבור השירותים הניתנים הוא חודשי או חד-פעמי, בהתאם להסכם בין הצדדים. מרגע שהלקוח שילם עבור השירות, לא יינתן החזר כספי עבור התקופה שכבר שולמה, בין אם מדובר בתשלום חודשי מתמשך או בתשלום חד-פעמי.
• רישיון שימוש בשירותים דיגיטליים: תשלום בעבור שירותי שרת וירטואלי פרטי ו/או שירותי אחסון אתרים הינו עבור רישיון שימוש בשירות לתקופה מסוימת. התשלום עבור תקופת השירות הוא סופי ולא ניתן לביטול או להחזר לאחר שהחלה אספקת השירות. הלקוח מאשר כי שירותי שרת וירטואלי פרטי נחשבים כשירותים דיגיטליים בהתאם לתקנות הגנת הצרכן (ביטול עסקה), תשע"א-2010, סעיף 6(א)(7), וכי אין זכות החזר כספי עבור שירותים דיגיטליים לאחר תחילת השימוש בהם.
• שירותים שהושלמו: שירותים בתשלום חד-פעמי, כגון בניית אתרים, התקנות תוכנה, קונפיגורציה או ייעוץ טכני, אינם ניתנים להחזר כספי לאחר השלמתם, ללא קשר לאיכות התוצאה לשביעות רצונו של הלקוח.
• אי-שביעות רצון: אי-שביעות רצון הלקוח משירות מסוים, או חוסר שימוש בשירות בפועל, אינם מהווים עילה לקבלת החזר כספי. התשלום עבור השירותים הוא סופי ואינו תלוי בשביעות רצון הלקוח מהשירותים או משימוש בהם בפועל.

5.2 הפסקת שירות והחזרים במקרה של תקלות

• הפסקת שירות יזומה או הפרה: הלקוח מסכים כי לא ניתן לדרוש החזר כספי כלשהו אם השירות הופסק במהלך התקופה על ידי הלקוח או בשל הפרת תנאים מצדו. התחייבות לתשלום חודשי מתמשך תחול עד לתום תקופת ההתקשרות המוגדרת.
• תקלות ואחריות מוגבלת: במקרה של בעיה טכנית או השבתה בשירותים, לא יינתן החזר כספי, אלא אם כן הדבר נובע מרשלנות ישירה מצד גולד לינק. בכל מקרה אחר, לרבות בעיות חיצוניות, תחזוקה או עדכוני מערכת, הלקוח מבין כי לא יהיה זכאי להחזר או זיכוי עבור הזמן שבו השירות לא היה זמין.
• חיוב חריגה מרוחב פס: במידה והלקוח לא בחר באפשרות לחסום את השירות באופן אוטומטי עם סיום מכסת רוחב הפס שהוקצתה לו, יחול חיוב נוסף בגין כל חריגה ממגבלת התעבורה. החיוב הנוסף יתבצע באופן אוטומטי בהתאם לתנאים שנקבעו בהסכם ההתקשרות.

6.1 איסוף מידע וסיווגו

במהלך הגלישה באתר או השימוש בשירותים, נאסף מידע, המופרד לשני סוגים עיקריים:

1. מידע שאינו מזהה אישית (NPII) / נתונים סטטיסטיים: מידע שנאסף לצרכים סטטיסטיים, תפעוליים וניהוליים – כגון כתובת ה-IP שלך, העמודים בהם ביקרת, סוג הדפדפן ועוד.
2. מידע מזהה אישית (PII) / פרטים אישיים: מידע המזהה אותך באופן אישי, כגון פרטי תשלום או פרטים שמסרת במודע לצורך רכישת שירותים. מידע זה ישמש אך ורק למטרה זו, אלא אם ניתנה הסכמה מפורשת אחרת.

6.2 שיתוף נתונים והגנה על מידע אישי

• אבטחה והגנה על PII: המידע המזהה אישית המוחזק במערכות החברה מאובטח בהתאם להוראות חוק הגנת הפרטיות, התשמ"א-1981, ובהתאם להנחיות הרשות להגנת הפרטיות. כל שימוש במידע ייעשה בכפוף למטרות לגיטימיות, לרבות שיפור השירות ואספקת שירותים מותאמים אישית.
• שיתוף נתונים סטטיסטיים: החברה עשויה לשתף פעולה עם חברות כגון גוגל (Google) ופייסבוק (Meta). חלק מהמידע הסטטיסטי שאינו מזהה אישית ייחשף לחברות אלו במסגרת מדיניות הפרטיות שלהן, לטובת ניהול קמפיינים ושיפור דירוג האתר.
• העברת מידע אישי מותנית בהסכמה: החברה עשויה לשתף נתונים מזהים אישית עם צדדים שלישיים רק לצורך אספקת השירותים הנדרשים, ובכפוף להסכמתך המפורשת. המידע עשוי להימסר גם במסגרת הליכים משפטיים או מיזוגים עסקיים, כל עוד הגוף המקבל את המידע מתחייב לכבד את תנאי מדיניות הפרטיות.
• חריגים להסכמה: החברה שומרת לעצמה את הזכות לשתף מידע מכל סוג רק במקרים בהם היא מחויבת לכך על פי חוק או צו שיפוטי, או כאשר הדבר נחוץ להגנה על זכויותיה.
• שימוש בעוגיות: באתר נעשה שימוש בטכנולוגיות כגון עוגיות (Cookies) לצורך תפעול האתר, שיפור חוויית המשתמש והתאמת תוכן ופרסומות. ניתן לחסום את השימוש בעוגיות דרך הגדרות הדפדפן, אך פעולה זו עשויה להשפיע על תפקוד האתר.

6.3 אבטחת מידע והגבלת אחריות מפני חדירות

• אמצעי אבטחה והגבלת אחריות: כל המידע של גולד לינק מאוחסן בענן מוצפן ובחוות שרתים במדינת ישראל ומגובה ביבשות נוספות שמיקומיהן חסויים. החברה מיישמת באתריה מערכות ונהלים עדכניים לאבטחת מידע. בעוד שמערכות ונהלים אלה מצמצמים את הסיכונים לחדירה בלתי-מורשית, אין הם מעניקים ביטחון מוחלט.
• ויתור על טענות בעקבות פריצה: החברה מתחייבת שבכל עת תעמוד לרשותה תעודת אבטחה מאומתת בתוקף וכן ינקטו פעולות עדכון פרוטוקול האבטחה, אך החברה לא מתחייבת ששירותיה יהיו חסינים באופן מוחלט (סטרילי) מפני גישה בלתי-מורשית למידע המאוחסן בהם. הגולש מוותר מראש על כל טענה שיכולה לעלות בעקבות פריצה פלילית למערכות המידע של גולד-לינק.
• ניטור פעילות: החברה שומרת לעצמה את הזכות לעקוב אחר פעילות משתמשים במערכותיה ככל שיעלה חשד לפעילות עוינת או מזיקה.

6.4 זכויות הגולש והלקוח

• זכות עיון ותיקון: על-פי חוק הגנת הפרטיות, התשמ"א – 1981, כל אדם זכאי לעיין במידע שעליו המוחזק במאגר מידע. אדם שמצא כי המידע אינו נכון, שלם, ברור או מעודכן, רשאי לפנות בבקשה לתקן את המידע או לבקש את מחיקתו.
• דרישה למחיקה: אם המידע שבמאגרי החברה משמש לצורך פניה אישית אליך, אתה זכאי על-פי חוק הגנת הפרטיות, התשמ"א- 1981 לדרוש בכתב שהמידע המתייחס אליך יימחק ממאגר המידע.
• שינויים במדיניות: בכל מקרה בו יבוצעו במדיניות זו שינויים מהותיים בהוראות שעניינן השימוש במידע אישי שמסרת, תפורסם על-כך הודעה בעמוד הבית של האתר.
• פנייה: פניות לעיון, תיקון או מחיקת מידע יש להפנות אל [email protected] או באמצעות פנייה בכתב לשירות הלקוחות של האתר.

2.1 Surfer Obligations and Fair Use Rules

• Fair and good faith use: The surfer is obligated to use Gold Link's information systems in good faith and for legitimate purposes only, and to maintain general caution rules on the internet according to all local and international law.
• Copyright protection: All content on the site is protected by copyright, including code, images, etc. It is forbidden to copy, reproduce, modify, reuse, download or distribute this content, it is clarified that the brand is a partner in Google's global search engine brand protection program.
• Access limitation: The site reserves the right to block access for a specific surfer or audience without reason and/or prior notice, as the site is defined as private business property allowing public access at its sole discretion.
• Automatic control mechanisms and filtering hostile activity: The website consists of an information system that classifies surfers according to a large number of variables, and the system can block surfers automatically based on security breaches, unfair resource use, or suspicion of industrial espionage. There is human control in addition to strict security protocol for identifying breaches and activating special measures to neutralize the source of the breach.
• Robot filtering obligation: As part of efforts to protect the site and filter hostile activity, we use Google's reCAPTCHA service. Use of reCAPTCHA service is mandatory to ensure site activity is legal and safe. The information collected through it is subject to Google's privacy policy.

3.1 Limitation of the Company's Liability

• Limited responsibility to infrastructure: As a company providing cloud services, our responsibility is limited to the availability of basic services and their functionality as much as possible.
• Removal of responsibility for content and activity: Gold Link does not bear responsibility for the activity of sites hosted on its server or content published on its infrastructures. Any use or activity that is not part of the basic services is the sole responsibility of the end user.
• Removal of browsing responsibility: Gold Link removes from itself any responsibility for consequences that may arise from browsing the site or sites hosted on its servers. Any direct or indirect liability and/or responsibility for damages resulting from browsing, purchase or contact with public service operator employees is not the company's responsibility at all.
• Absence of legal affiliation: It is clarified that the site is not responsible at all for public service operator products, and the surfer understands that mere storage of files on Gold Link servers does not grant him legal affiliation to Gold Link when he surfs a customer operator's site.
• Specific terms of use: The company reserves the right to define other terms to each customer separately, including rates, terms of use or delivery times, at its sole discretion and without being required to provide explanation.

3.2 Obligations of Public Service Operator

• Exclusive responsibility for content and products: The exclusive responsibility for services and products on customer sites is that of Gold Link customers only. The customer accepts upon himself all risk involved in using services provided by Gold Link, including risk of claims from third parties regarding actions performed through the services.
• Legal use and security: The customer undertakes to use Gold Link services in accordance with the law and for legal purposes only. The customer is obligated to implement appropriate information security measures to prevent abuse of resources, security breaches or any illegal action, including incitement to violence or activity that violates third parties' rights.
• Compliance with privacy laws and location: The customer is obligated to act in accordance with local and international privacy protection laws, and to ensure that all activity conducted within the services complies with the applicable regulation in his areas of activity. If complaints or claims are received regarding these breaches, the customer will be the sole responsible for any damage or result arising therefrom.
• Responsibility for resources and bandwidth overrun: The responsibility for monitoring resource use lies with the customer. If the customer did not choose the option to automatically block the service upon completion of the allocated bandwidth quota, an additional charge will apply for any overrun of the traffic limit. The customer confirms and understands that Gold Link is not obligated to alert on overrun in real time.

3.3 Service Termination and Unilateral Sanctions

• Service termination at sole discretion: Gold Link reserves the right to terminate the provision of services to a customer at any time, at its sole discretion and without need for prior notice or reason.
• Immediate sanctions in breach: In case of hostile activity or material breach of terms of use, Gold Link may disable the services immediately, delete the information stored on servers, and demand compensation for direct and/or indirect damages caused to it or third parties.
• No entitlement to refund: In case of service termination due to breach or non-compliance with terms, the customer will not be entitled to monetary refund for the remaining period of the discontinued services.

The Vexa platform offers "AI-to-Production Power" and enables the creation of advanced digital media. The platform enables instant creation without registration and without details ("Create instantly. No signup, no details").

• Free creation and internal use: The platform can be used for creation and polishing of digital materials. Use of outputs internally (such as screenshot) does not violate the company's policy.
• Ownership security: According to Vexa rules, anyone can claim materials in the absence of secured ownership. The customer can purchase ownership security at any later time, but his materials remain unclaimable until someone else secures ownership.
• Expectation of credit: The company expects that credit to Vexa will be mentioned somewhere if the digital content was prepared using the platform.
• Launch: After securing ownership, the customer can purchase the desired package directly on the materials and launch the product.

5.1 Final Payment and No Refund

• Final payment: The payment for the provided services is monthly or one-time, according to the agreement between the parties. Once the customer has paid for the service, no monetary refund will be given for the period already paid, whether it's ongoing monthly payment or one-time payment.
• License to use digital services: Payment for private virtual server services and/or website hosting is for a license to use the service for a certain period. The payment for the service period is final and cannot be canceled or refunded after the service provision has begun. The customer confirms that private virtual server services are considered digital services according to Consumer Protection Regulations (Transaction Cancellation), 2010, section 6(a)(7), and there is no right to monetary refund for digital services after starting their use.
• Completed services: One-time payment services, such as website building, software installations, configuration or technical consulting, are not refundable after completion, regardless of the result's quality to the customer's satisfaction.
• Dissatisfaction: Customer dissatisfaction with a certain service, or lack of actual use of the service, do not constitute grounds for monetary refund. The payment for the services is final and does not depend on the customer's satisfaction with the services or actual use of them.

5.2 Service Termination and Refunds in Case of Malfunctions

• Initiated service termination or breach: The customer agrees that no monetary refund can be demanded if the service is discontinued during the period by the customer or due to breach of terms on his part. Commitment to ongoing monthly payment will apply until the end of the defined engagement period.
• Malfunctions and limited liability: In case of technical problem or service downtime, no monetary refund will be given, unless it arises from direct negligence on Gold Link's part. In any other case, including external issues, maintenance or system updates, the customer understands that he will not be entitled to refund or credit for the time the service was unavailable.
• Bandwidth overrun charge: If the customer did not choose the option to automatically block the service upon completion of the allocated bandwidth quota, an additional charge will apply for any overrun of the traffic limit. The additional charge will be made automatically according to the terms set in the engagement agreement.

6.1 Information Collection and Classification

During browsing the site or using services, information is collected, divided into two main types:

1. Non-personally identifiable information (NPII) / Statistical data: Information collected for statistical, operational and managerial purposes – such as your IP address, pages visited, browser type, etc.
2. Personally identifiable information (PII) / Personal details: Information that identifies you personally, such as payment details or details you provided knowingly for purchasing services. This information will be used only for this purpose, unless explicit consent is given otherwise.

6.2 Data Sharing and Personal Information Protection

• Security and protection of PII: The personally identifiable information held in the company's systems is secured in accordance with Privacy Protection Law, 1981, and in accordance with the Privacy Protection Authority's guidelines. Any use of the information will be subject to legitimate purposes, including service improvement and providing personalized services.
• Sharing statistical data: The company may collaborate with companies such as Google and Facebook (Meta). Some non-personally identifiable statistical information will be disclosed to these companies within their privacy policies, for campaign management and site ranking improvement.
• Transfer of personal information conditional on consent: The company may share personally identifying data with third parties only for providing the required services, and subject to your explicit consent. The information may also be provided in legal proceedings or business mergers, as long as the receiving entity commits to respecting the privacy policy terms.
• Exceptions to consent: The company reserves the right to share any type of information only in cases where it is required by law or judicial order, or when necessary to protect its rights.
• Use of cookies: The site uses technologies such as cookies for site operation, user experience improvement and content and ads personalization. Cookies can be blocked via browser settings, but this may affect site functionality.

6.3 Information Security and Liability Limitation Against Breaches

• Security measures and liability limitation: All Gold Link information is stored in encrypted cloud and server farms in the State of Israel and backed up in additional continents whose locations are confidential. The company implements up-to-date systems and procedures for information security in its sites. While these systems and procedures reduce risks of unauthorized penetration, they do not provide absolute security.
• Waiver of claims following a breach: The company commits that at all times it will have a valid certified security certificate and security protocol updates will be taken, but the company does not commit that its services will be absolutely immune (sterile) from unauthorized access to the stored information. The surfer waives in advance any claim that may arise following a criminal breach into Gold Link's information systems.
• Activity monitoring: The company reserves the right to monitor user activity in its systems if suspicion arises of hostile or harmful activity.

6.4 Surfer and Customer Rights

• Right to review and correction: According to Privacy Protection Law, 1981, every person is entitled to review the information about them held in a database. A person who finds that the information is not correct, complete, clear or updated, may request to correct the information or request its deletion.
• Deletion request: If the information in the company's databases is used for personal contact with you, you are entitled according to Privacy Protection Law, 1981 to demand in writing that the information referring to you be deleted from the database.
• Changes in policy: In any case where material changes are made to this policy regarding the use of personal information you provided, a notice will be published on the site's home page.
• Contact: Requests for review, correction or deletion of information should be directed to [email protected] or by written contact to the site's customer service.
